1. Introduction

These Terms of Service (“Terms”) govern your access to and use of Jaguar Hosting’s website, services, and products (“Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Account Registration

You must create an account to use certain features of our Services. You are responsible for maintaining the security of your account and password. Jaguar Hosting cannot and will not be liable for any loss or damage resulting from your failure to comply with this security obligation.

3. Service Provision and Limitations

3.1 Service Availability

We strive to ensure our Services are available 24 hours a day. However, we do not guarantee that our Services will be available at all times. We reserve the right to suspend or restrict access to some features to users.

3.2 Acceptable Use

You may only use our Services for lawful purposes and in accordance with these Terms. You agree not to use our Services:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate Jaguar Hosting, a Jaguar Hosting employee, another user, or any other person or entity
• To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Services

3.3 Resource Usage

Our hosting plans come with defined resource allocations. Excessive use beyond these allocations may result in additional charges or service limitations. We reserve the right to monitor server resource usage and take necessary actions to prevent excessive usage where it impacts other users.

3.4 Prohibited Content

You may not use our Services to store, publish, or transmit:

• Material that infringes intellectual property rights
• Illegal content or content promoting illegal activities
• Malware or harmful code
• Spam or unsolicited commercial content
• Content that is excessively violent, threatening, or harassing
• Content that promotes discrimination, racism, or hatred

4. Payment and Refunds

4.1 Pricing

You agree to pay all fees associated with your selected hosting plan. All fees are in US Dollars unless otherwise specified.

4.2 Billing Cycle

We bill in advance for our Services on a monthly, annual, or other term basis as specified during the purchase process.

4.3 Refunds

We offer a 30-day money-back guarantee for new accounts. If you are not satisfied with our Services within the first 30 days of your initial purchase, you may request a full refund. This guarantee does not apply to renewal payments, domain registrations, or additional services.

4.4 Late Payments

If payment is not received by the due date, we reserve the right to suspend or terminate your Services until payment is made.

5. Cancellation and Termination

5.1 Cancellation by Customer

You may cancel your Services at any time through your control panel or by contacting customer support. No refunds will be issued for cancellations after the 30-day money-back guarantee period.

5.2 Termination by Jaguar Hosting

We reserve the right to suspend or terminate your access to our Services immediately, without prior notice or liability, for any breach of these Terms.

5.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination.

6. Data Backup and Loss

You are responsible for maintaining your own backups of your data. Jaguar Hosting is not responsible for the loss of any of your data, the data of your customers, or any other data contained on our servers or within our Services.

7. Intellectual Property

The Services and their original content, features, and functionality are owned by Jaguar Hosting and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Limitation of Liability

In no event shall Jaguar Hosting, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

9. Indemnification

You agree to defend, indemnify, and hold harmless Jaguar Hosting and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Costa Rica, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. It is your responsibility to review these Terms periodically for changes.
